How to File a FOIA Request in Alcona County

Michigan's Freedom of Information Act, codified at MCL § 15.231 et seq. and passed as Public Act 442 of 1976, gives any person the right to request public records from government agencies in Michigan. You do not need to state why you want the records. As spelled out in MCL § 15.233, there is no residency requirement either. Anyone can file a request.

To request Alcona County police records, write a letter or fill out a standard FOIA request form. Include your full name, mailing address, phone number, and email address. Describe the record you want clearly enough that the office can find it. Include the date of the incident, the names of people involved, and an incident or case number if you have one. Send your request to the Alcona County Sheriff's Office at 214 W Main St., Harrisville, MI 48740, or call (989) 724-6271 to ask whether email or fax submission is accepted.

Under MCL § 15.235, the office must respond within 5 business days of receiving your request. They can extend that by up to 10 additional business days if the request is complex or requires a large search. They must send written notice if they use the extension. If your request arrives by email or fax, it is considered received on the next business day after you send it.

If the agency denies your request, they must tell you in writing which exemption applies. You have 180 days to appeal. The appeal goes to the head of the agency. If the appeal is also denied, you can bring a civil action in circuit court. Michigan law allows courts to award attorney fees to requesters who win wrongful denial cases.

Note: Always put "FOIA Request" in the subject line of any email submission so the office can route it to the right person quickly.

Fees for Alcona County Police Records

Alcona County follows the standard fee schedule set by Michigan FOIA law under MCL § 15.234. The standard copy fee is $0.10 per page for letter or legal size paper. For other formats or digital media, the actual cost applies. Searches that take less than 15 minutes carry no labor charge.

If the total estimated fee will exceed $50, the office can require a 50% deposit before starting work. If you have an unpaid prior FOIA request on file, they may require full payment in advance. Estimates are valid for 45 days. If you miss the deposit deadline, the agency can close your request.

Low-income requesters can get a fee waiver. Under Michigan law, you can submit an affidavit showing you receive public assistance or cannot pay. The first $20 of fees will be waived. You can claim this waiver up to twice per calendar year. It does not apply if you are making the request on behalf of a third party who is paying you.
